These Terms of Use and Sale ("Terms") govern your access to and use of yourhomeschoolcompanion.com and any guides, digital or physical products, personalized plans, consultations, educational materials, email content, or other services offered by Your Homeschool Companion ("YHC," "we," "us," or "our"). By accessing the website, downloading a resource, submitting an order, or using a YHC product or service, you agree to these Terms. If you do not agree, do not use the website or purchase or download our offerings.
1. Eligibility and Adult Use
You must be at least 18 years old and legally able to enter a binding agreement to make a purchase or request a personalized service. The website and its offerings are intended for parents, guardians, and other adults—not for use directly by children.
2. Educational Information; Not Legal Advice
YHC provides general educational information and support about homeschooling. We are not a law firm, and no website content, guide, email, personalized plan, or communication constitutes legal advice or creates an attorney-client relationship.
Homeschool laws, withdrawal requirements, reporting rules, and official guidance can change and vary by jurisdiction and personal circumstances. You are responsible for confirming current requirements with your state or local education authority and, when appropriate, a qualified attorney. You remain responsible for all decisions concerning your family, children, curriculum, instruction, and legal compliance.
3. No Professional or Outcome Guarantee
Our resources are not medical, mental-health, financial, tax, or other licensed professional advice. Individual results vary. We do not guarantee that a resource, plan, strategy, or service will produce a particular educational, financial, legal, family, or business outcome.
4. Products and Services
YHC may offer free guides, paid digital downloads, courses, templates, physical merchandise—including apparel, mugs, notebooks, accessories, homeschool-related products, and similar merchandise—personalized homeschool starting plans, educational support, and related services. Descriptions, availability, features, and pricing may change. We may correct errors, limit quantities or availability, or discontinue an offering at any time.
5. Orders, Payments, and Delivery
You agree to provide accurate, current information and to pay all displayed charges and applicable taxes. Payments may be processed by third-party providers, and their terms may also apply.
Digital products are generally delivered by download link, email, account access, or a third-party platform. You are responsible for providing a working email address, checking spam or promotions folders, and maintaining compatible devices and software. If you do not receive access within a reasonable time, contact us at elisabeth@yourhomeschoolcompanion.com.
Physical merchandise may be produced, printed, assembled, personalized, or otherwise fulfilled after an order is placed. You are responsible for reviewing product descriptions, sizing information, colors, quantities, personalization, and shipping information before submitting an order. Product images are illustrative, and reasonable variations in color, placement, or appearance may occur because of device displays or normal production processes.
Made-to-order items may be canceled or changed only before production begins. Once an item has entered production, the order generally cannot be changed or canceled. If we cannot ship within the time stated, or within another period required by applicable law, we will provide any delay notice, cancellation option, or refund required by law.
6. Refunds, Returns, Exchanges, and Order Problems
Because digital products may be accessed immediately, and because personalized plans and services require reserved time and individualized work, sales of digital products, personalized plans, and services are final and non-refundable, except where a refund or other remedy is required by applicable law.
We do not provide refunds for change of mind, failure to use a digital product or service, duplicate purchases caused by the customer, dissatisfaction based on personal preference, or inability to achieve a particular outcome. If a digital file is defective, an access link fails, or a purchased digital item is not delivered, contact us promptly. We will make a reasonable effort to restore access, replace the defective file, or otherwise correct the delivery problem.
Physical merchandise that is printed, manufactured, personalized, or otherwise produced after an order is placed is made to order. Except where applicable law requires otherwise, we generally do not accept returns, exchanges, or refunds for buyer’s remorse, an incorrect size, color, quantity, or personalization selected by the customer, an incorrect or incomplete shipping address supplied by the customer, or another customer ordering error. Please review product descriptions and sizing information carefully before purchasing.
If a physical item arrives damaged, defective, misprinted, incorrect, or materially different from what was ordered, contact us at elisabeth@yourhomeschoolcompanion.com within 30 days after delivery, or within any longer period required by applicable law. Include your order number, a description of the problem, and clear photographs of the item and its packaging when reasonably available. Do not return an item unless we provide return instructions.
After reviewing a qualifying claim, YHC may provide an appropriate replacement, reprint, refund to the original payment method, store credit, or other remedy depending on the circumstances and product availability. If a return is required, we will provide instructions. Nothing in this section limits any right or remedy that cannot lawfully be waived or restricted.
7. Personalized Plans and Services
Personalized offerings are based on the information you provide and are educational recommendations, not guarantees or licensed professional advice. You are responsible for providing complete and accurate information. Delays in your responses may delay delivery. Unless a written offer says otherwise, revisions outside the stated scope, substantial changes after work begins, or additional consultation may require a separate fee.
8. Limited License for Personal Use
Unless stated otherwise, YHC grants the purchasing or downloading customer a limited, revocable, non-exclusive, non-transferable license to use the resource for that customer’s own personal or household homeschooling purposes.
You may not reproduce, resell, redistribute, share access credentials or download links, publish, upload to a shared drive, translate, modify for resale, create derivative commercial products from, or use YHC materials to train an artificial-intelligence system without our prior written permission. One purchase does not create a school-wide, co-op, group, classroom, or commercial license.
9. Intellectual Property
The website and its content—including text, graphics, branding, logos, photographs, guides, downloads, designs, videos, and other materials—are owned by or licensed to YHC and protected by intellectual-property laws. “Your Homeschool Companion” and related branding may not be used in a manner that suggests endorsement or affiliation without written permission.
10. Testimonials, Reviews, and Submissions
If you voluntarily submit a testimonial, review, photograph, comment, or other content for possible publication, you confirm that it is truthful, that you have the right to provide it, and that it does not violate another person’s rights. Unless we agree otherwise in writing, you grant YHC a non-exclusive, worldwide, royalty-free license to reproduce, format, publish, and display the submission for business and promotional purposes. Contact us if you later request that an attributed testimonial be removed; we will consider reasonable requests, subject to materials already produced or legal retention needs.
11. Acceptable Use
You agree not to:
- violate any law or another person’s rights;
- interfere with website security or operation;
- attempt unauthorized access to systems, accounts, or content;
- introduce malware, scrape the website abusively, or use automated means that burden the service;
- impersonate another person or provide fraudulent information;
- use YHC content for unlawful, misleading, or commercial redistribution; or
- remove copyright, trademark, or proprietary notices.
We may restrict or terminate access for suspected violations.
12. Email and Electronic Communications
When you subscribe or request a resource, you consent to receive communications related to that request. Where permitted, we may also send educational or promotional email. You may unsubscribe from marketing messages at any time, though transaction, access, customer-service, or legal messages may still be sent.
13. Third-Party Services and Links
The website may use or link to third-party platforms for hosting, payments, email, analytics, downloads, social media, or other functions. We do not control and are not responsible for third-party content, availability, policies, security, or performance. Your use of a third-party service may be governed by its own terms.
14. Website Availability and Changes
We aim to keep the website and resources available, but access may be interrupted for maintenance, security, technical problems, provider outages, or other reasons. We may update, suspend, replace, or discontinue content or features without guaranteeing continued availability, subject to obligations for completed purchases.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the website, content, products, and services are provided “as is” and “as available.” YHC disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that content is complete, current, error-free, uninterrupted, secure, or suitable for every family or jurisdiction.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by law, YHC and its owner, personnel, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, educational outcomes, family decisions, or legal consequences arising from or related to the website, a product, a service, or these Terms.
To the fullest extent permitted by law, YHC’s total liability for a claim will not exceed the amount you paid to YHC for the specific product or service giving rise to that claim during the twelve months before the event giving rise to liability. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless YHC and its owner, personnel, contractors, and affiliates from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website or materials, your violation of these Terms, or your infringement of another person’s rights.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in a court of competent jurisdiction in Texas, and the parties consent to that jurisdiction and venue, except where applicable consumer law requires otherwise.
Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally.
19. Termination
We may suspend or terminate access to the website, services, or licensed content if you violate these Terms, misuse an offering, threaten security, or fail to pay required charges. Provisions that by their nature should survive termination—including intellectual-property, payment, disclaimer, limitation-of-liability, indemnification, and dispute provisions—will survive.
20. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted with a revised date. Changes apply prospectively unless applicable law permits otherwise. Continued use after updated Terms become effective constitutes acceptance of the updated Terms.
21. Miscellaneous
These Terms, together with any specific written offer terms and our Privacy Policy, form the agreement between you and YHC concerning the applicable website use or purchase. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with our business or assets.
